Does my Child have to use a Child Seat in the car? - child car seats - the law and penalties

Lucinda Dore Solicitor is often asked this question by her clients and fellow parents so we thought we would clarify this for people.

  •  We can tell you that the simple answer is YES - if your child is under 12 years old or less than 135 cm tall.
  •   If they are over 12 or 135 cm tall they do not have to use a child car seat but they must wear a seatbelt if there is one available.

Don't forget that it is the drivers responsibility to ensure this law is complied with and a Fixed Penalty Notice (£100) can be issued if child seat laws are broken.  Find all the Government guidance here
